ChecksOn.Me - Privacy Policy
This Privacy Policy explains how ChecksOn.Me, Inc. ("ChecksOn.Me," "we," "us," or "our") collects, uses, protects, and, in limited circumstances, discloses information and data provided by users of our mobile application, website, and related services (collectively, the "Services").
By using the Services, you agree to the terms of this Privacy Policy.
1. The Information We Collect
We collect information directly from you, automatically through your use of the Services, and from third parties (like our payment processor).
1.1 Information Provided by Patrons (Customers)
When you use the Services to open or pay a tab, we collect:
Identity Data: Your name, email address, phone number, and date of birth (DOB).
Transaction Data: Purchase details, Merchant location, time of transaction, tip amount, and final tab amount.
Payment Data: Tokenized payment information (e.g., a secure, non-sensitive payment token provided by Apple Pay, Google Pay, or our payment processor, Finix). This also includes your billing address as required by our payment processor for card verification and compliance. We do not store full payment card numbers (PANs) on our servers.
1.3 Data Collected Automatically (Usage and Technical Data)
When you access the Services, we automatically collect:
Usage Data: Details about your interaction with the Services, such as pages viewed, features accessed, and the time and duration of your activity. For Patrons, this includes when a tab is opened and closed.
Technical Data: Device type, operating system version, device identifiers (like the IDFA for iOS or AAID for Android), IP address, language settings, and crash logs.
Location Data: General location data inferred from your IP address or, if enabled by your device settings, precise location data necessary to identify which Merchant you are physically interacting with to open a tab.
2. How We Use Your Information
We use the collected information for the following primary purposes:
2.1 Service Delivery and Functionality
To process and settle financial transactions between Patrons and Merchants via our payment processor.
To manage Patron Member accounts.
To facilitate the core functionality of opening, managing, and automatically closing virtual tabs.
To send transactional notifications (e.g., tab status, payment confirmation).
2.2 Product Improvement and Error Resolution
We use aggregated and, where possible, anonymized data (logs and records with no Personally Identifiable Information (PII)) to:
Improve Usability: Analyze usage patterns to enhance the user experience and interface for both Patrons and Merchants.
Ensure Functionality: Monitor the Services to confirm they are error-free and functioning as expected.
Develop New Features: Understand market needs and prioritize development efforts.
2.3 Legal Compliance, Security, and Fraud Prevention
This is a critical function of our platform as a financial services provider. We use and retain data, including Transaction Data and Payment Data, to:
Prevent Fraud and Illegal Activity: Detect, investigate, and prevent fraudulent transactions, chargebacks, and other illegal activities, including attempts at money laundering.
Comply with Law: Retain records as required by financial regulations, tax laws, and anti-money laundering (AML) statutes in the jurisdictions where we or our partners operate. Transaction records are retained for the legally mandated period.
Enforce Terms: Enforce our Terms of Service, particularly regarding unpaid balances (Section 15).
2.4 Data Sharing (We Do Not Sell Your Data)
We share your information only in the following limited circumstances:
With Merchants: We share Patron Identity and Transaction Data necessary for the Merchant to fulfill your order, reconcile books, provide service, and enforce their policies (e.g., identifying "bad actors").
With Service Providers: We share data with third-party vendors, consultants, and payment processors (like Finix) who perform services on our behalf and are contractually obligated to protect your information.
Legal Requirements: We disclose information when required by law, subpoena, or legal process, or if we believe disclosure is necessary to protect our rights, safety, or the safety of others.
3. Your Choices and Data Retention
3.1 Data Retention for Compliance
You acknowledge that due to our role in facilitating financial transactions, we are legally required to retain certain Transaction Data and associated personal data for extended periods, even after you close your account. This retention is mandatory to comply with financial regulations and cannot be overridden by user requests until the minimum legal retention period has passed.
3.2 Opt-Outs and Usability Degradation
You may opt out of certain data collection features (e.g., marketing communications, precise location sharing), but you understand that opting out of necessary data collection may result in a degradation of usability or prevent you from accessing certain features of the Services. For example, disabling location services may prevent the application from correctly identifying the Merchant where you wish to open a tab.
3.3 Accessing and Correcting Your Information
If you have a Member account, you can review and change your personal information by logging into the application. For data we maintain for legal and security purposes, access may be restricted.
3.4 Data Deletion Rights
You have the right to request the deletion of your personal data we have collected, subject to applicable law, including data privacy laws such as the European General Data Protection Regulation (GDPR).
How to Request Deletion: To submit a data deletion request, please contact us using the information in Section 6.
Our Retention Obligation: Please be aware that as a financial service provider, we are legally obligated to retain certain data. Even if you request deletion, we will maintain the retention of all transaction records, billing addresses, and payment tokens for the minimum period required by law (e.g., for fraud prevention, anti-money laundering compliance, and tax purposes). Upon request, we will delete all data we are not legally required to keep and will anonymize or pseudonymize the remaining records to the highest practical standard.
4. Third-Party Websites
The Services may contain links to third-party websites (such as a Merchant's website). This Privacy Policy does not cover the practices of those third parties. We encourage you to review the privacy policies of any third-party sites you visit.
5. Changes to Our Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the Effective Date at the top of this policy and, where appropriate, through the application or via email. Your continued use of the Services after the changes take effect constitutes your acceptance of the revised policy.
